They may go in the backsplash just not flat in the countertop

I am not aware of any minimum height above the countertop that a receptacle has to be placed. The only requirement would be that they can not be faced in an upward position to keep moisture and gunk from falling into the recepatable openings. (NEC 406.4(E) 2002 Ed.)

If you are under the 2003 IRC kitchen counter outlets shall be located not more than 20 inches above counter top per E3801.4.5

Thanks for all of the replies.

Just to clarify;

Outlets can not be placed flush on the kitchen counter surface.

Outlets mounted on the backsplash do not have a minimum height required from the kitchen counter surface.

Outlets mounted on the backsplash have a maximum height of 20" from the kitchen counter surface.

Another detail question;
Is there any issues with having the outlet sideways? ie; the outlets to the left & right of each other instead of on top of each other?

No problem with mounting them sideways.
