Home builders applaud property rights legislation. Calling it an important step forward for property rights, the National Association of Home Builders (NAHB) applauds the U.S. House of Representatives for passing the "Private Property Rights Implementation Act" (H.R. 4772), legislation designed to ensure that property owners can have their Fifth Amendment takings claims heard in federal court. Under existing law, property owners must litigate their case in state court before a federal court will rule on a Fifth Amendment takings claim. But once a takings claim has been heard by a state court, the landowner cannot have the claim heard in federal court. Property owners are effectively precluded from having their Fifth Amendment takings cases heard in federal court.

APA-sponsored team assists in Mississippi rebuilding efforts. A five-member volunteer planning team sponsored by the American Planning Association's (APA) professional institute, the American Institute of Certified Planners, worked with Henderson Point, Mississippi, residents recently to create a town center rebuilding plan to guide area redevelopment for the next 20 years. Virtually every structure in the city was destroyed by Hurricane Katrina. The team also helped facilitate a county-sponsored town hall meeting to gather resident input on rebuilding efforts.

fire codes could put many ghosts and goblins in Black Hawk County, Iowa, out of work this Halloween. The county Board of Supervisors voted to reject an ordinance amendment that would have allowed haunted house attractions in rural areas to post a $1 million liability insurance policy instead of following the building code requirement for sprinklers. Board members supporting the requirements said they couldn't cut corners on public safety matters or open the county up to massive lawsuit liability by downgrading the codes, despite concerns the decision could force two rural haunted attractions out of business.

Inn evacuated due to code violations. Authorities in York, Pennsylvania, ordered the evacuation of a local inn for failing to comply with city building codes. Mayor John Brenner said the motel has been a concern of city officials for years. "There have been a number of violations there over the years. That hotel has long been a problem. And we are tired of it," Brenner said. The latest problem at the three-story, 57-room motel occurred when the alarm system malfunctioned.

2006 IBC Transition from the 1997 UBC
Authored by Doug Thornburg, AIA, C.B.O., ICC Director of Product Development, this workbook focuses on helping users that are familiar with the 1997 UBC adapt to the 2006 IBC and details the differences between the two codes, and covers concepts that are not in the 1997 UBC. In an effort to further aid users, this workbook provides an explanation as to how the codes differ with further clarification on location of code requirements in the UBC and IBC that are the same, but are now located in different sections.

Speaking during the Opening Session, Stewart encouraged conference delegates to seek new methods and technologies to combat America's growing energy consumption. "We need to change the way we consume energy in this country," Stewart said. "It's the challenge of not just a year or two, but the challenge of a generation. I look forward to collaborating with your organization to achieve it."

Patrick J. Natale, P.E., CAE, Executive Director, Chief Staff Office and Secretary of the American Society of Civil Engineers (ASCE), told delegates he looks forward to ASCE and ICC working together even more closely as ICC moves its headquarters to Washington, D.C. "It's important for the design community to work with the enforcement community in the obligation we jointly share to be stewards of the built environment."

American Society of Heating, Refrigerating and Air-Conditioning Engineers (ASHRAE) President Terry E. Townsend urged ICC to incorporate a new standard for green buildings into its codes during the 2006 Annual Conference. The standard, under development by ASHRAE, the U.S. Green Building Council and the Illuminating Engineering Society of North America, will be complete in late 2007. "I ask you to join me and let us work together like we've never worked before because we have a duty and responsibility to our children and our grandchildren to provide them with a future of hope and opportunity rather than one of fear and uncertainty. Don't you think that they deserve a sustainable future? ICC and ASHRAE working together can make a world of difference."

Dr. S. Shyam Sunder, Acting Director of the Building and Fire Research Laboratory at the National Institute of Standards and Technology (NIST), thanked ICC for helping to educate and inform NIST on the code development process, especially as it relates to code changes stemming from NIST's investigation of the World Trade Center collapse. "We owe you (ICC and its members) our deep gratitude for the work you do day in and day out."

Rick Vognild, retired Director of Technical Services for the legacy organization Southern Building Code Congress International, was the recipient of the Bobby J. Fowler Award during the 2006 ICC Annual Conference. The Fowler award, the highest honor given by ICC, is presented to an individual whose contributions to the building safety industry advance ICC's goals in achieving a safer built environment.

Donald "Mickey" Arp of Chattanooga, Tennessee, was named Code Official of the Year at this year's Annual Conference. Other award winners included: Robert Davidson of Davidson Code Concepts, Fire Official of the Year Award; Shirley Muns of Texas A&M University, ICC Affiliate Award; and Jill Gray of the North Central Texas Permit Technician Chapter of ICC and the Washing Association of Building Officials, which were presented Community Service Awards. Wally Bailey, Director of Development and Construction for the City of Fort Smith, Arkansas, was elected President of the ICC Board of Directors during the Annual Business Meeting at the 2006 ICC Annual Conference. Steven I. Shapiro, Director of Codes Compliance for the City of Hampton, Virginia, was elected Vice President, and Adolf Zubia, Fire Chief for the City of Las Cruces, New Mexico, was elected Secretary/Treasurer. Members also elected six Directors.

The ICC Board of Directors promoted the association's Chief Operating Officer, Richard P. Weiland, to the position of Chief Executive Officer. Weiland, who has been ICC's COO for the past three years and has more than 20 years experience working in the public sector and not-for-profit world, succeeds James Lee Witt.

An assessment team from the American National Standards Institute (ANSI) recently visited the ICC-ES Los Angeles office to perform its annual reassessment that is required under the ANSI program for accreditation of organizations certifying products. ANSI accredits ICC-ES for its work in certifying the code compliance of building products. A two-person team, consisting of lead assessor Lynne Neumann and technical expert Joel Miller, reviewed the ICC-ES quality system, including policies, procedures, records keeping, staff training, the work of ICC-ES committees and advisory bodies, and interactions of ICC-ES with its subcontractors and with manufacturers. The team plans to wrap up the 2006 ANSI reassessment later this month and in early November with visits to the ICC-ES offices in Birmingham and Chicago.

Four National Certifications Are Available
Certification and Testing Services has implemented four new national certifications through ICC's Computer-Based Testing (CBT) network. The new certifications are Disaster Response Inspector, Certified Fire Marshal, Structural Steel and Bolting Special Inspector, and Structural Welding Special Inspector. Full details on each of these new certifications are available on the ICC website.

NIST hosts Iraqi engineers. The National Institute of Science and Technology (NIST) recently hosted a delegation of Iraqi engineers involved with the Ministry of Construction and Housing to discuss the American codes and standards. ICC was represented at the conference by Foundation President Paul Myers and Federal Programs Liaison Richard Kuchnicki.
