Inspection Concerns: Gathering Evidence & Right of Entry

During this webinar, the limitations placed on the official’s authority to enter a structure or premises for the purpose of inspection are explored. The webinar will highlight gathering information in a uniform way that will enable participants to be successful in court, obtaining documentary evidence from a variety of sources, and identifying the various types of evidence used in court. Additional topics include how to conduct constitutionally valid inspections and reduce civil liability, how to gather information to draft an administrative search warrant, and ways to avoid the common mistakes made by inspectors during inspections.
This is a three hour webinar based on the Adminstrative Provisions within the 2006 IBC, IFC, IPMC and IRC, Sections 104.3 through 104.6. The concerns that every inspector faces in the field, gathering evidence and right of entry are discussed as well as ways to avoid common mistakes by inspectors during inspections.
Objectives
Upon completion of this seminar, you will be better able to:

Instructor
Linda Pieczynski
Linda Pieczynski, J.D. is an attorney engaged in the general practice of law with a special emphasis on municipal prosecution in areas of zoning and building code violations. Previously, Linda worked for the state’s attorney in DuPage County, Illinois where her responsibilities included conducting seminars for law enforcement agencies. She currently represents numerous municipalities as their village prosecutor.
Linda is a graduate of DePaul University in Chicago and is a member of the Illinois Bar Association, DuPage County Bar Association and the DuPage Association of Women Lawyers. She has written several books and has published articles on various legal topics. Additionally, Linda rewrote the “Legal Aspects of Code Administration” textbook.
